Personal Injury

Car crashes. Trips and falls. Surgical errors. Sometimes accidents are unavoidable. However, there are times when an accident occurs because of the negligence of another person or company. Even a minor accident can result in large medical bills, loss of income, and an inability to lead a normal life.

We are prepared to assist you in obtaining the compensation you deserve.

Auto accidents

Motor vehicle accidents are the single most common cause of injury and harm caused by the negligence of other people and companies.  Accordingly, there are specific laws which apply to motor vehicle accident cases, whether involving private passenger vehicles, buses, trucks, or pedestrians.  These laws apply to all aspects of your claim, including payment of medical bills, reimbursement of property damage, and compensation for pain and suffering and lost wages. When you are injured in a motor vehicle accident, it is important that you hire a car accident attorney as soon as possible so that your claim is handled properly from the outset without adversely affecting your right to recover for the harm which you suffered.

We are experienced in handling all types of cases involving injuries resulting from motor vehicle accidents, from basic rear-end hit collisions, to those involving intoxicated drivers, intersectional collisions, taxicabs, pedestrians, trucking and bicycle crashes, and accidents which cause devastating vehicle damage and catastrophic injuries or death.

Bus accidents

Public transit can be an affordable and convenient option. Unfortunately, accidents do occur. Poorly trained or negligent workers can cause accidents, as can equipment failures. In addition, SEPTA and other public transportation companies are protected by laws that only apply to them. If you or a loved one has been injured in an accident involving a SEPTA bus or train—or any other bus—we can help.

Construction site accidents

Large, heavy equipment, power tools, scaffolding, and other hazards involved in working in and around construction sites combine to create a risky workplace—and a danger to the public. Even when all safety measures are followed, accidents still happen. Employers, property owners and contractors may be liable for injuries suffered by construction workers injured on the job, as well as bystanders injured in construction accidents.  However, obtaining a fair settlement or award from a construction company usually involves the use of qualified experts and requires the assistance of an experienced personal injury attorney.

Personal injury FAQs

What is a personal injury claim?
If you suffer harm or injury due to the negligence (fault) of another individual or company, you are entitled to monetary compensation under our legal system.  The amount of compensation to which you are entitled is dependent on a significant number of factors and types of proof, including the type of injury you suffer, your medical treatment, medical bills, wage loss, and the circumstances which gave rise to the injury.  Personal injury claims can arise out of many different types of situations including motor vehicle and bus accidents, trip-and-falls, construction and worksite injuries, environmental conditions, physician malpractice and defective products.  Each type of personal injury claim is governed by a unique set of laws and legal requirements.

How much is my case worth?
There is no standard answer—it depends on the details of your case. Damages are determined by the level of negligence involved, the severity of your injuries, and any monetary losses or expenses causes by your injury.

How do I get what I am owed for my personal injury claim?
It is important to work with an attorney or law firm experienced in handling personal injury claims. From the time you are injured, your attorney can guide you through what you need to do to protect and enforce your rights. Your attorney can help assemble all of the evidence that will be needed to prove your case and maximize the outcome. Depending on the type of case, an attorney can retain qualified experts to help establish the fault of the other party or to demonstrate and prove your damages. At the appropriate time, your attorney will work to settle your case and/or file a lawsuit on your behalf to obtain the best possible result on your behalf. At Solnick & Levin, we view our clients as our partners in the claims and litigation process. We provide personal attention to each case and client and work closely with our clients on every legal matter.

How does the type of automobile insurance I have affect my case?
It is important to purchase the type of coverage that adequately protects you and your family. When buying insurance or reviewing your policy, you should consider that many people are either driving a vehicle without insurance (uninsured) or without enough insurance (underinsured). It is important to purchase insurance coverage that protects you and your family in the event of an accident involving an uninsured or underinsured driver. Under Pennsylvania law, every person who purchases automobile insurance must decide if they want “full tort” or “limited tort” coverage. If you select limited tort coverage, with certain exceptions, you are essentially giving up your right to pursue a claim for pain and suffering even if you are injured as a result of the negligence (fault) of another driver. Whether you have full tort or limited tort coverage, an automobile accident attorney can help you understand your rights and obtain all benefits and compensation to which you are entitled. Even if you are subject to limited tort coverage, we may be able to obtain a settlement or award on your behalf by finding an exception to limited tort that applies to you.

How can an attorney help me with getting compensated for damage to my car?
Although you will only be charged a fee based on a settlement or award for your injuries, we help ensure you receive compensation to have your car fixed if it is repairable or compensation for the loss of your vehicle if it is totaled. Likewise, we will help you get an adequate rental vehicle while your car is in the shop and compensation for towing charges if necessary. Your right to these types of compensation might depend on the type and amount of insurance coverage which you or the responsible party maintains, but we will never charge you any fee to assist with your property damage claim if it is related to an accident in which you suffered injuries.

Who pays for my medical treatment when I am involved in a motor vehicle accident?
Under Pennsylvania law, your own insurance company (or the insurance company covering the vehicle you are occupying if you do not have automobile insurance in your household) is responsible for your medical bills associated with a car accident regardless of whose fault the accident was. If your medical bills exceed the amount of coverage you have on your insurance policy, any excess bills will be paid either by your health insurance carrier or by the responsible party’s insurance. Either way, we can help you fight the insurance companies if they attempt to cut off your medical benefits before your treatment is complete or if there are problems obtaining coverage for your treatment. Likewise, at the conclusion of your case, we work with your medical providers to ensure any unpaid bills are paid at a fair rate.
